This is on behalf of my boyfriend. I'm not involved just getting info for him.

Boyfriend got ex pregnant 3 years ago. Ex moved to michigan and had daughter, would not let boyfriend sign birth certificate, but told her to take him to court and get child support/ insurance for little girl. Ex said no. Boyfriend thought he had no rights so he just tried to be in the little girl's life as much as the ex would allow. She allowed 2 visits but for awhile she would call to let him know how little girl was doing. Ex never gave him her address, or number. He didn't know how to get ahold of her, or send money, clothes, ect... Months later I come into the picture, she tried to break us up by telling me through myspace that he was bad, abusive, that he would hurt my kids, whatever. When it didn't work she told him she wanted her and her daughter to be left alone. She stopped calling and all he has is a few pictures and a couple fleeting memories of the little baby. Little girl will be 3 in a month. About a year ago the ex moved to IA with new husband, and started hanging around his so called friends, in IL. Now all of a sudden, she called and said she wants him to be in little girl's life now. Was told that ex's current husband signed birth certificate and was lately told that he didn't sign it. Ex is going through a divorce with husband, and going to be remarried as soon as it is finalized. No legal father ever established. The ex wants my boyfriend to be in little girls life, but tells him that the new "fiance" is wanting to adopt little girl and be the real dad. Now comes the questions. Oh, her residency is in IA we are in IL.

Does boyfriend have anything he can do to establish paternity or has the timeline expired?

Can someone be adopted without a legal father ever being established?

Is ex being nice to boyfriend to get him to let an adoption take place that he could stop?

What if anything can he do?

Does he just have to play nice just to be able to see little girl?

We already know that if boyfriend is established as legal father that he would owe a lot of back child support that he would be happy to pay as long as he could possibly have visitation rights that were denied to him in the very begining. Thanks for your info.

ur bf has the legal right 2 request a paternaty test and 2 fight for visation and even cust. i sugest ur bf hires a lawyer and establishes paternaty quickly, once thats established then he would have to sign parental rights away b4 child could be adopted. my hubbys ex gf has tried for the last 3yrs to get him 2 sign. good luck

Your boufriend needs to find out if he is the father first. He should request a paternity test. I recommend he talk to a family law attorney to see about serving mom with a paternity action. The child is already 3, your boyfriend needs to make up his mind on what he wants to do. Keep in mind that if no legal father was established, mom canf ile for child support at any time. I say your boyfriend establish paternity asap and then file for visitation.

Not to sound rude, but my boyfriend didn't even have the option till now to be apart of his daughters life and thought that there was a time limit for how long he even had a chance to file for paternity. He doesn't care about the money, he'd figure out a way to pay it. He just wants a chance with his daughter.

So direct him to this site and he will be advised on how to assert his rights. Forums like this have been available for the last 15 years or so...It isn't hard to find.:)
