Unwed mother seeks custody of 7 month daughter

My boyfriend and I were living together in San Antonio, Texas. (Bexar County)
We had both been using illegal drugs and we both came to the decision to stop. I stopped while my boyfriend continued using. We had an argument about his continued use and he ended up taking our daughter, 6 months at the time, to his parents house in New Braunfels, Texas (Comal County 15 miles away) He did this while I was at work so I came home to a half empty house. :confused:

The next day I tried to go over there to see our daughter and I was assaulted by my 240 lb mixed martial arts trained boyfriend but yet when I called the police they arrested me because he had visible scratches on him from my defenses. I am 130 lbs with no training. My boyfriend did not press charges but I went to jail. Upon release the arresting officer served a 31 day protective order preventing me from seeing my now ex boyfriend and my daughter. :oMy bruises were visible and I pressed charges.

3/1/2010 I filed for custody in Bexar County where my child, myself and my now ex boyfriend have lived for a few years. We went to court only to find that my ex boyfriend filed first in Comal County, I had not been served. The judge ruled that she didn't have jurisdiction. My lawyer didn't have his Code book so we were unable to point out section 155.203 county of jurisdiction says that jurisdiction is in the county that which the child resided for the 6 months prior to suit.

4/10/2010 I was served with suit from Comal County. It states that my ex boyfriend had care control and custody for 6 months prior to suit. :no:(He did but in Bexar County with me)

Present day: We have filed a special appearance in Comal County along with a motion to transfer venue. We have also filed a motion for temporary custody with Bexar County. We have a court date this Friday.

I can prove that I have been the primary caregiver prior to suit. I have held a job both during and after the pregnancy, paid the bills, fed the baby, clothed the baby, did the housework, planned play dates, planned babysitters, made and attended all doctors appointments, etc. He has not had a job since I have been with him. I have been drug tested with negative results 3 times voluntarily. I have completed anger management, seen 2 therapists, and a psychiatrist, have attended AA meetings, and enrolled in an 8 week parenting class, all voluntarily. I have been clean and drug free since before all this happened.

I don't want anything sugar coated. Do I stand a chance at getting my baby? Is there anything else I need to do?

You're doing everything, the right way, to get your baby back.

Just keep your head down, and keep driving on toward your goal.

Don't let him sweet talk you out of anything, either.

You see what kind of bum he is, and abuser, too!

Follow your lawyer's advice, and the judge will follow the law.

That creep will soon get his legal rewards.

You'll have your precious child back, Friday.

If not Friday, very, very soon.

I didn't know Army Judge was psychic.

OP-you are doing everything right. You do have a chance of getting your baby back. If a decision is not made Fri you need to get a set visitation schedule in place so you can see the child. Does Dad have an attorney? Good for you on getting your act together and cleaning yourself up. Make sure your attorney fights for you.
 
I understand there is no way to predict a judges ruling. Otherwise lawyers would charge $10,000 an hour. I just wanted a legal opinion.

There are mistakes done by both parties and I am wiling to move on from those decisions. It just seemed that Daddy hasn't swallowed his pride and has been using our daughter as a leash over me. That is just a feeling not a fact.

Yeap - I'm in agreement with Duranie.

I'm just VERY wary of making such assured statements when we cannot predict the future :)
 
Well rest assured I am not going to present this answer to the judge and say,"See, Army Judge said I am going to get my baby back! So gimmie!"

For some reason I am just not as confident as I think I should be. I appreciate any advice and understand that it is in fact "advice"

I always attempt to be supportive of the good deeds of others.

When people try to correct their prior misdeeds, they should be supported and not thwarted.

The OP knows that I am not able to practice "psychic law", and knew that I was encouraging her efforts.

I saw no need to beat her while she's trying to get up and stand on her own.

She's beaten herself up enough already.

As you noticed, I went on to say, if not Friday, soon.

I wish everyone well.

Why can't she work hard to get her child back?

She deserves a second chance.

God knows I've had quite a few!!!

Great news! We went to court and the judges face was worth a thousand words. He was disgusted with the fact that my ex boyfriend had been withholding our baby from me. We now have an agreed order one week with me and one week with him. I'm just happy I get to have her for my first mothers day! I get to pick her up at 6 CST today.

No child support and no one has primary residence. I am ok with that until the real hearing. Plus that gives us a 50/50 on any physical advantages. And it was done in Bexar County with no special appearance filed by the other lawyer. Doesn't that basically say that venue should be Bexar County?

My ex and his parents would not look at me in the eye. I think it's a sign of immaturity and guilt. Only an opinion. Thank you for listening!

First of all, since your baby can't say it YET, let me say; Have a Very Happy FIRST Mother's Day, Mom!!!

Secondly, Bexar County will be the venue going forward.

Don't concern yourself with what happens at the hands of Satan's minions.

Give the naysayers and troublemakers no thought or credence. You just keep on driving ahead for that little girl's benefit!!!

One more thought to always keep in mind.

See how great it feels when your reward arrives for doing well and working hard?

Capture this moment, memorialize it, use it to create many, many more special moments.
