I resigned from a company January 2008 after providing them a 30-days notice. Per our contract, payroll was the 15th and last day of each month (direct deposit). Beginning November 2008, huge amounts were missing from my direct deposits (the owner said the company was low on funds). He provided multiple contracts afterward agreeing to pay me what I was owed by certain dates; however, payments continue to be either late, missing, or not made at all. I am still owed $2,500 seven months after the completion of my work. I know I can sue for the principal amount owed, but in Georgia, can I sue in magisrate court for the following:
1) damages (this was PAYROLL-- my main source of income)
2) interest (since my earned money has been withheld for over 6 months)
3) breach of contract (he broke one verbal/oral and more than three written
agreements, all of which I have in my possession)
