Hi, I'm going to small claims court on 05.31.07-taking my boss to court on the following grounds, but I have a question:1. he did not give me my last pay check after several attempts on my part to contact him via phone and email. 2. reimbursements due to me - unpaid. 3. overtime...I worked on average 13hrs per day with only 1 day off per week. - we verbally agreed that I have 2 consecutive days off-never happened. 4. he fired me stating that I had to pay $150.00 for a replacement [I called him to request a personal day-it was an emergency on my part]. He stated that I was incapable of doing my job,etc. Even after I had spoken to him continously about my having time off.
Now that he's gotton the summons...he wants to pay. Should I continue with court or reply back to him [boss]?
PS...I'm in NYC...the law states that I'm to be paid, if fired on the next pay date...I called and emailed him several times - with no response until now.
