trying to get the legal full costudy

My ex wife and I executed and had notarized an adjusted parenting plan agreement and we have been acting in compliance with it for approximately 7 years. We never filed it (I have been moving due to my job in the US military) but have not wavered from the terms.

Currently I have joint custody and she will not agree to a passport for our child. I have an overseas assignment and need a passport so she can come with me pursuant to our agreement. I filled out a special circumstances form with the passport agency. Is there any way to get the judge to order her to comply with the passport consent?


I have been taking care of my child since she was born because her mother left her and moved to different state to follow her bf( that's when she signed,notarized and gaved me all the rights). The only time that she has her was when I had to go overseas for an assighment( 2004-2005) for 1 year and I got my daughter back as soon as I got back to states, got married and now I am back to overseas for an assignment again. We wanted to bring her with us but couldn't because she don't have no passport and her mother won't sign the paper for passporting. She is currently living with my sister(oklahoma) for a year now. my ex-wife has never support her,no presents no anything eversince. My ex wife recently visited her family(coz someone paid for her plane ticket) and for her brother's graduation day. and that's the first time that she's seen her in 4 years. My ex-wife has lost costudy of her second daughter recently. She has been in jail a lot of times for some issues.

I was told that if i set a hearing and my ex-wife dont show up,that i will win already, is that true?
and can I request a telephone hearing because I am in overseas? (flying back and fourth is expensive)

This is very tricky and subject to much controversy.
As you see, she can block the passport.
You need a lawyer to handle this for you.
But, there are no guarantees.
Request the hearing and let your lawyer fight for you and your daughter.
It won't be as easy as you've been led to believe.
But, you're in a potentially good place.
No matter what happens, your daughter is safe with her aunt.
