trying to get custody of my knephew

Hi, my name is Rebecca Smith, I'm trying to get some advice on getting custody of my knephew Peyton. His father has not seen him in over three months and has had battery charges on him in the past. My sister who has had him the whole time is now trying to get back with the father which she nor he has a job and can not take care of Peyton. Me and my husband has had Peyton every other weekend as it stands now for two months. I would really appreciate some help on this matter to keep Peyton out of harms way. thank you in advance..

You have no standing to file for custody.

Your sister is presumed to be fit, as is the father she chose, until a court says otherwise. Given that child services obviously haven't deemed them to be unfit, you have absolutely no chance of getting custody unless both parents agree.
