Truancy and emergency motion

My jurisdiction is: Florida

We're in Georgia but DH's oldest 2 sons are in Florida with bioMom.

DH rec'd report cards of oldest son 4 weeks ago, contained in which were 2 failing grades. BioMom has ignored DH's phone calls and emails regarding the grades. Son has also not returned DH's phone calls or text messages. Finally, school contacted DH to say that son has missed 20 days this quarter (quarter started January 5th) - every Monday thru Thursday for past 5weeks. According to school, they contacted bioMom 2 weeks ago and she told them that son had stomach issues and a doctor note had been forwarded to the school office. Also according to school, last Tuesday biomom was contacted that son was not at school and the truancy officer was on his way. BioMom left work to go home, retrieve son and take him to school.

DH finally got bioMom to answer her phone and asked what the deal was. She claimed the school was lying about the doctor's note, yet she never denied she knew son was at home and not at school. She told DH that son is having issues at school. DH countered that conversations with teachers reveals that son is an 'A' student when he comes to school. Also that DH has never been contacted by biomom about any of these issues. She hung up and hasn't answered the phone since.

Since this began, she refuses to have either son call DH (son is 1 month away from 15). Neither answer their phones when DH calls them. He and younger brother (1 month away from 14) are due to be here in 2 weeks for Spring break. The day before DH's email to bioMom about the grades, boys were texting and calling DH like normal.

Greatly concerned about older son's emotional and mental well-being. He's been very withdrawn on last couple of visits (Christmas and Summer), and makiing comments about telling mom that he died so he didn't have to go back. He has talked to DH about moving here to Georgia but knows that his mom won't let him. Biomom has told DH that will never happen (sons moving here).

There's a lot more to all this than just the truancy, but this is the first solid "evidence" we have of a wayward home life there. We've hoped and prayed that it wouldn't become the situation it has. Our worst nightmare is here.

School is contacting DH on Monday about next steps. An unofficial recommendation from his Georgia attorney is to have the school send the truancy officer to remove son from home, have bioMom charged with 2nd degree misdemeanor (Florida charges parents of truant children), then file an emergency motion for custody of both boys.

Any other suggestions or thoughts??
 
I suggest that you stop referring to the MOTHER of the children as 'biomom'.

Thanks for the suggestion :D, but that's what she is. She did give birth, but hasn't been much of a mother. I assume you would make the same suggestion to someone who referred to an uninvolved biological father as a 'sperm donor'?
 
because of the ages of the children, they should be able to choose which parent they want to live with. I dont know how it is in all states but in most, once a kid is a certain age they can choose who they live with. You may have to get a lawyer for it but it sounds like the kids would be better off not with their mom. Just the fact that she hasn't even tried to tell the father about any issues shows she has something to hide or doesn't care enough to let him know.

Children do not get to CHOOSE in ANY state. Period.
