Timeframe for pay

I worked a position as an independent contractor for a staffing agency called Encore Nationwide on September 14, 2008. In there agreement, pay is to be received in at least 8 weeks, by mail. 8 weeks would have been November 9, 2008 and it is currently November 14, 2008 and I still have not received my check. Is there any legal action I can take?

As an independent contractor, employment laws do not apply to you. Therefore your recourse would be small claims court.
