An "executive manager" tells a 16 year salary employee (also a manager)to his face that he has been trying to fire him since he (the executive manager) has worked here which is just one year. He told him he is having trouble firing him, he can't find a good cause and told the employee that he will get it done. Is this a form of harassment?

Under Federal law, illegal harassment is that which is based on race, religion, national origin, gender, disability, pregnancy, or being over 40. The state of Kansas recognizes illegal discrimination/harassment based on military status and genetic testing information in addition to the above.

Without a valid and supportable reason that the reason for the manager's treatment is BECAUSE OF the employee's membership in one or more of the above groups, any alleged harassment is not illegal.

Thank you.

This manager has managed to fire 7 people all over the age of 40 and all men. The paperwork just says that their position is no longer needed but yet they have managed to replace everyone of these people with younger personal. Just wondering. Thanks for the info!

If those employees believe that they were fired BECAUSE OF their age and gender, they can file with the EEOC.
