the union representative is making the schedule

isn't it a conflict of interest if the union does the employee's schedule. unfortunately this situation is happening now in the hotel where I work. and I'm a victim of this misconduct because the union rep who's doing the schedule is giving himself and his fellow friend the right to pick and choose the shift they like. the result other colleges can't have 40 hours.
can I sue the union for breach of trust.

No, you can't. There's nothing in the law that says who is permitted to make up the schedule or who is entitled to the best shifts. The union has no duty to you unless you are a member.

For that matter, why aren't you a member? Massachusetts is not a right to work state.
