Question I'm confused about....I ALREADY TOOK THE TEST, but this is still bothering me...

Joe is in a hurry and runs into Cindy knocking her to the ground. Joe is liable for negligence:

A.) Only if Cindy is injured.
B.) If Cindy is not injured.
C.) Whether or not Cindy is injured.
D.) Under no circumstances.

My first answer was A. But I thought about it and figured this seems more like a case of assault than negligence. So I chose D. I could be way off though!
