I have a horrible ex who is abusive and has gotten worse since he returned from iraq. He refuses to get help, so heres the deal were going to court on three different contempts of court failure to comply with agreed parenting plan , paying medical co - pays and the child support order. Since were going thru all this in the state of Tennessee, Texas the kids legal residence is stepping in and were seeking termination of rights so my current husband can adopt them. Now I have heard many rumors and my lawyer charges for every minute it seems like, So Once his rights are terminated does he still have to pay the arrearages from child support or is it wiped clean? And also I heard that even if you terminate rights and your spouse adopts them , that unless abuse is proven the biological parent that loses rights can maintain there visitation rights? I am using this law Texas Laws :Citation: Fam. Code §§ 161.003; 161.005; 161.006; 161.007 The parent's rights can be terminated on the grounds of abandonment, nonsupport, endangerment, abuse, or neglect. So my question is what can happen will I still have to let the kids see him ? Is he going to pay back owed money? And exactly what happens when he claims in court he cant afford an attorney but he makes more money than us? Any info will help so i dont incur anymore bills.
 
generally in a termination of rights the bio dad loses ALL rights. He still does owe back support. you are going to somehow have to find an attorney to help with the termination and adoption. This is not a do it yourself project.

I know you said you have a lawyer. Have you considered pre-paid legal services? I had that in California and they gave me a lawyer who would look over my documents and answer any questions I had. They'd also give advice. It was kind of like paying for car insurance. I had to pay only $35 a month for their services. If you needed them to go to court for you, then you'd get a 25% discount on their services. It's an idea but it's really up to your own personal preference. It doesn't mean you have to stop seeing your current lawyer, but maybe you can "get some help" for free. Just thought it might help. :)
 
Prepaid legal is spam and not allowed on this site. PPL is not an attorney they charge you a monthly fee for what generally is VERY limited coverage for family law. Do not go this route.
 
I had a feeling someone would post something negative about it. I personally didn't receive any spam or have any problems with it. But I didn't stick with it long enough to have any negative feeling about them either. My reasons of terminating their services had nothing to do with their services but, like I said, it's per your personal preference. You may be right Duranie.
