Terminated for violating a "policy" that one is unware of..

If your given a reason you are fired for example: Violation of company policy, but there is no written policy or evidence that the policy exists can an employee fire you even if the employer themselves violated the policy in question or the "made-up" policy. I'm guessing the answer is going to be "YES"...seems so absurd to me though..
 
That depends for unemployment purposes it may not make muster, and you could prevail. As far as litigation and your state check with an attorney more and more states are expecting company's to live up to policy's set out in handbooks and alike.
