My ex-wife is currently going through a divorce with her current husband. She has not worked in the last several months, and recently moved into an apartment paid for by her husbands family. Shortly after moving in, they decided not to pay her rent and she will now soon lose the apartment. She called me in a state of panic wanting to know if I will take custody of our two sons so she can get things straightened out. What do I need to do to cease child support during the time I have custody of them? Does anything have to be done through the courts?
 
yes you need to file to stop child support, trying going through the states bureau. If support is paid through them or a clearinghouse your support arrears will tack on. If you pay her directly then you can maybe just get something notarized fromher that the kids are living with you and child support is temporarily stopped.

With an agreement like this though, since it is not a court order it may be hard to enforce meaning mom can come get the kids anytime. you might want to file for temp. custody if the kids are changing schools.
