Nephew living with my husband and I for over a year. We have only a notorized school district guardianship. returned from vacation and my sister wanted to see him. We agreed to an overnight vist. She sent a text message asking for his things and said she was keeping him. Just happened yesterday. We are in shock. Child is only 5. Her lifestyle is out of contoll. Should we react with an attorney for the child welfare?

You should contact the police or child welfare services if you believe the child is in danger.
Why worry about custody? You should be concerned with child safety. You never had custody.

We don't know how the Mother's lifestyle is out of control. She is his Mother - she can take him; you don't currently have custody. If you are concerned that the Mother's lifestyle is putting the child in danger, then contact CPS (or the police if in immediate danger).
