Take away vacation time?

Hi,
My boyfriend works for a large motel chain. After working for them for a year, they gave him 40 hours of vacation time (which he has not used). After 2 years, they gave him another 40 hours (also unused). Just weeks before he hit his 3 year mark, they suddenly changed the rules stating that anyone who has worked there from 1-3 years will lose any vacation time that they have accrued above 80 hours. So when he hit his 3 year mark, he got nothing. Can they do that? We live in California. Also, this company offers no sick days or anything like that. Thanks for any help you can offer. Bobbie
 
While they cannot take away any time that he has already earned (in CA - that would not be the case in all states) if he has reached the maximum they need not give him any more. Even in CA, the employer can cap the amount of vacation an employee holds.

No law in any state requires an employer to provide paid sick time.
