Is it illegal to register a child with their Fathers surname, without his presence? p.n Mother and Father have never been married or lived together. Fathers name is not on the birth certificate.

The name of a child is dependent upon the law in the country you are in and may also be affected by the state you are resident in the United States. In many states in the U.S., you can name a child anything within reason, including first name, middle name and surname. I believe (but am not sure) that this is also the case in the United Kingdom. You will want to discuss this case with a barrister or lawyer in the UK. Good luck with your child.
