Im the father, boy is 7, and mother is remarried, voluntarilly resigned from employment. She filed through CSE to evaluate an increase and tryed to claim 0 income on her side of the work sheet. CSE imputed her previous income, and Calculations came back proposing a $180 monthly decrease. This was calculated and signed by CSE staff back on 06-19-2012. She motioned to deny, hence our trial date. Im fairly confident that the new calculation will be adopted. Court ordered negotiation and mediation have been completed already. My question is can i file to have overpayment/back support reembersed to me for $180 x 6months? if so, what is the JDF file #, and do i need to provide this prior to our hearing? Thanks for reading.

You do not have an overpayment. Your payment due remains the same until the court changes the amount. That has not happened yet.

It is common for any modification to be made effective from the date of filing.

Since we do not have the exact wording however, we simply cannot say.
