Streaming Music

I am the owner of a server and I found an account on it that was streaming Music that the account owner had bought from http://musicnet.com/.

Is it illegal for him to be streaming music openly to anyone who visits his website?

10 will get you 20 that you'll find the answer in the terms of service on musicnet.com... Here's what I found and regardless of what the specifics are (capturing the stream, providing a link, etc.) the answer should be obvious...

"Except as provided above, you may not reproduce, republish, post, transmit or distribute any Materials, link directly to any Materials, or attempt to "pass-off" any Materials as your own work. "
