I am the older brother of a 11 year old girl who is currently in DHS custody. She was taken removed from the home because her step-dad (who is actually biological father) that she has known for apprx 2 years has performed a multitude of acts that would at the very least be considered lewd. These acts include forcing her to sleep with him while the mother slept in another room, putting his tongue in her ear, spanking her bare bottom with his hand, exposing himself, exposing to porn on a mobile phone, and more. Are many of these acts as defined by 21 OK Stat § 21-1123 (2014) not considered criminal and guilty of a felony? My sister has exposed this information to counselors and social workers, however her step-dad has not faced any backlash besides a 'threat of harm' and 'failure to protect' accusation on the CPS case. Is it possible for any legal action to be taken against him?

Are you above the age of majority, as in an adult?
If you are, report your observations/allegations to the police.
You would also be well advised to speak with the poor child's mother, grandparents, aunts, uncles, or other adult relatives.
If what you've alleged is true, make sure the authorities know what this child has endured.
 
Unfortunately it is true. I am 23 years old and live on the opposite side of the state. The child's entire family knows. She is currently living with grandparents (mom's), and will soon be moving in with an aunt. She cannot come with me due to my work schedule, I am a consultant and travel a lot. My dad, who raised her, is on the case as well for "Failure to Protect", but that is another story in itself. Basically, he can't take her either and I can't take her with him around per CPS. She is wanting to get out of her hometown because she is deathly afraid her stepfather will retaliate against her. The mother married the guy a week after CPS removed the child from the home and they both have a long history of methamphetamine use. A detective was investigating the case but has not returned my calls for several months. This has been going on since Mid-February, the CPS portion anyhow. This has clearly been going on for a long time. I am just curious as to why this guy has clearly broken the law as defined by the statue and why he has not been apprehended and prosecuted and if there are any steps I can take beyond the local police department to ensure that this is handled properly. She will be 12 in December.

You can speak directly with the county prosecutor or district attorney.

It just burns me when government officials chirp about protecting children, until children really need protection, and nothing gets done.
