Accident occurred 1.1.2013 when would I be barred by statute from making a claim . which day exactly would be my last day to claim

We don't know what type of claim nor against whom. For example, if you want to sue the City of New York or the State of New York, you usually need to file a notice of claim. A "notice of claim" that informs a municipality about a negligence lawsuit usually requires filing between 60 and 120 days in most jurisdictions. I would doubt you have any ability to sue that defendant at this date.

That said, we also don't know what types of causes of action that are available to you. You would be best speaking to an attorney if you are unaware and you can feel free to share them here, even though my response is a little late (sorry.)
