I have a son who has had a learning disablity since elementary. In that time I have fought with everyone about his taking medication and his conduct at school. Now he is in the 12 grade, 18, drawing SS benefits from my SS. Last year he was suspended due to his conduct in school and was forced to go to a hospital for kids with problems, either this or I would be charged with medical neglect. I have asked those involved with him if they felt he could receive SSI for his learning disability and depression that accompanies it. I have never received any decent answer.
All last summer, I worked with my son trying to build his confidence in everything that he does. His progress was very good. However, recently, around 2 weeks ago, he had some problems dealing with a so called girl friend who really didn't want to be his girl friend. I tried to help him but he was very hardheaded about. Anyway, a situation happened at the school and he called the police for help as he said he was suicidal. He was evaluated and sent back to the same hospital but not in the adult section. After talking with him I get the impression that he is having some problems with the staff. I have asked for his doctor to contact me with no results.
Here is my question. Since his mother and I are not living together any longer and he was living with me at the time he decided to do this, can I do something that would allow him to get SSI. I feel so desperate about this because he has already been dropped from school because of his non attendance due to his hospital stay, and he already lacks the education to function as an adult. I am so worried about him and feel helpless to help him. I would like to call somewhere or talk to an attorney that would be able to represent my son during this stage of his life, but I don't know if this is even the right thing to do. I know that he will lose any SS benefits becasue of what the school has done. However if he had SSI he would at least be able to survive once out of school. My son is a good boy but lacks the education the damn system would not help him with. Please help....
