small claims defendant

a vehicle i consigned for has been voluntarily repossessed. i'm not the primary signer have been sued in small claims court. i have verified on carfax that the vehicle has not been sold yet. can the dealer sue me before selling the vehicle and without trying to sue the primary signer first? if so, when i summit my answer to the court i plan on countersuing as the dealer used deceptive collection practices... ie falsely identfying himself to my references to obtain information about me, such as my employer. (he never tried to get this info from me, although he had my contact number and spoke with me to arrange the repo.) also we offered to continue make pymts on the vehicle but the amount we offered was less than the amount due, and the dealer would not accept it thus we agreed to the repossession. any suggestions? thanks
