simple IRA account

I worked for a company for 23 months and was layed off due to lack of work. During that time I had been contributing money to the IRA account it wastaken directly out of my paycheck every pay period. I just received a statement from the company that was handling the account and found out that there had been know payments made to the acoount since Dec. 2007. After finding this out I started checking my pay stubs to see if the retirement deductions were still being taken out, well they were. I called my old employer and asked him what the problem was and if he was going to rectify the situation. He told me that he had a problem with his bookeeper and that he had to fire her and that there is nothing he can do about my money ( about 2800. dollars ) Is'nt he responsible for the money taken out of my check ? Is there anagency I can report him to or someone I can talk to about this? It seems to me that its like stealing money out of my pocket. Please advise. Thanks
