Hi,
I was caught from shoplifting $18worth pair of gloves.
(I do regret and I really won't do it again.)
I'm 17 years old, which is considered as minor according to Store rules, but as an adult to State law.
The store told me they will send me Civil Right Demand paper to my house.
They handed me down to police and I had my fingerprints and photographs taken.
I was told I'll be given a court date to be called on.

Since I'm up to department to be given a court date and had my fingerprints and photographs taken,
does that mean I'm charged as shoplifting?
If so, will this be on my record forever?
I'm 3.92 GPA student in high school with lots of big success in besides-school activities
and have no previous record.
Will I be able to get off from getting this on my record?
What will my consequences be like?
If I'll be given probation, what will be like exactly?

Because I read from other cases that I'll be required to stay home.
But as I mentioned above, there are lots of things I do for besides-school activities,
and need to go to other states or other countries often.

If I want to get this off from my record,
will I be needed to hire a lawyer?
My family isn't rich, so I'd like to get a Public Offender.
How does the process go?

I'm supposed to be on the trip to Europe this Saturday and be out for next 8 days.
The police told me the court date won't be that soon so it should be fine.
But will I be blocked from getting out of country?

3>
How much will the court fine me?
and how much will the store fine me?

OH,
I meant Public defender.

English is my second language and I'm still confused.
Is it Public Defender or Offender?

You have many questions but sadly they are all over your post. Can you post them in a fashion (see example) so we can address each one?

Sorry
I will try my best to arrange them.

1> What will happen at the court?
What's the best thing I can do to get this off from having this on my record?

2> I see there's Diversion Program, which will take this situation off from my record.
What exactly is Diversion and what conditions will I be given?

3> I'm planned to get out of the country this saturday,
will I be blocked from getting out? I'm going to Europe.

4> How much the store fine me?
How much the court fine me?

1> What will happen at the court?

YOur first court date will be arraignment. You will be read charges and asked to enter plea. A not guilty plea would be my suggestion so you can have time to discuss things with your Attorney

2> I see there's Diversion Program, which will take this situation off from my record.
What exactly is Diversion and what conditions will I be given?
These programs vary so you should ask your Attorney. The simple answer is it works like a conviction but onc eyou complete program your case is dismissed. once again these programs vary so ask your Attorney

3> I'm planned to get out of the country this saturday,
will I be blocked from getting out? I'm going to Europe.
No

4> How much the store fine me?
"Guess" (its only a guess) about $200.00
How much the court fine me?
Less than $500.00

Thank you for your reply!!!
There are some more questions I'd like to ask.

I found Free Consultation office and talked to the lawyer.
He told me that I should ask for Public Defender to get into Diversion Program.

1>
SO
when I go to court,
when the judge asks me plea guilty, do I say "Not plea guilty"?
So that judge will ask me to get a lawyer?

2>
What's the process in the court to get a Public Defender?

3>
If I get into Diversion program,
will my shoplifting case be on my record UNTIL I finish the requirements?

Yes

The Judge will explain once you ask

As you were told these programs vary. How it reads on the record will vary but it is "not" a conviction!

Then what will I be given if I don't get into diversion program?

Also, even if it doesn't read as a conviction on the record,
will it be a problem when I apply for college scholarship?

If you do not seek or are granted Diversion then you will likely have a conviction on your record. As you were told Diversion programs and their terms vary. However it slikely no College will see anything as they search for convictions and if you are granted Diversion there will likely be no conviction

Depends on what your talking about. The court cannot charge you restitution if store sent Civil Demand. However the court can charge criminal fines that are not restitution. Now in some states a store cannot file both criminal charges and civil demand. What state are you in?

Thank you very much for your answers!
You made me feel so much better.

I'm actually suffering from this situation.
I keep having flashback moments randomly,
(the moment when the alarm rang, the face of store managers and everything)
it's really hard for me to keep track on things and
I even wake up in the middle of nights remembering the time.

Could you please help me with this?
I really don't know what kind of help I need from you but I don't want to talk to my parents about this (about my mental suffering stuff) but I really need help...

This site is to help you with understanding the legal consequences of shoplifting both criminal and civil. We cannot help you with any emotional issues that might have come of this. If thats the case visit the NASP website andthey should have resources there that can help you
