I looked for other questions like mine, I could not find one, so I hope that you can help me. I live off of a US base in Germany. My husband and I are both US citizens. Recently, he had an inappropiate relationship with another military member. She is pregnant, and married as well. My husband and I are reconcially, but this pregnancy is weighing over us both. My questions are...
First, what set of laws will apply to this child since it was concieved overseas in Germany, state of the parents, or German law?
What is my husbands responsiblity in this? The woman does not know who the father is, her husband or mine.
Should he (my husband) request a paternity test first, or does her husband have to prove that he is not the father?
Sorry if this is unusual...I just need to know how best to protect my interests here.
Thank you~

In most, if not all, US states, the husband of any pregnant woman is legally the father of any child she bears. If he wishes, he can contest paternity; however, he will only be allowed to do so (legally) within the first year(s), unless he has been deceived into believing the child is his.

If your husband believes the child is his, and wants to establish paternity, he can file a motion. If he doesn't want to, he can wait and see what the husband does. If the husband contests, then the mother can file for child support from your husband, and a paternity test will be ordered at that time.

Military assignment can affect the application of state laws, so check with an attorney experienced in that area.

thank you, we are seeing a german lawyer in 2 weeks for more information, but, this seems to be the opinion of everyone i have spoke to, unless the husband contests, he is automaticlly assumed as the father. Does not mean that he will or will not contest, unfortunately, we will have to face her and deal with this at some point in time soon! Thanks for the info
