Seperated for 5 years no contact from father

My jurisdiction is: California

I am 26 years old and have been seperated from my husband for 5 years. He has not seen or made any attempt what so ever to contact myself our our child. He finally responded to the divorce papers after 5 years...how do I get his rights taken away? Can i actually do that?

You likely cannot take his rights away. Has he been able to locate you all this time? He is Dad and he does have rights. You can file for child support and ask for supervised visits until the 2 get acquainted again but the courts likely are not going to terminate rights if you are single and not remarried. Especially if you are still married to him.
