seeking what my rights are

my father passed away and my brother has power of attorney. However life insurance contacted me about a month ago and told me that if I could provide them with the death certificate and they would send me the money. Well now they are saying that my brother is the power of attorney and the beneficiary. How do I change the power of attorney to myself due to my brother shortly after the death went to prison for 2 years and has been in and out of rehab. for an addiction to heroin. He is incompetent and I was not aware that this insurance policy existed or I would have had the power of attorney changed. What are my rights? Thank you very much
