My professor kicked me out of class for missing 1 day of classes. There is a 20% attendance policy, Herkimer community college has. I was put into the class late, and he counted the time i was not enrolled in the class. CAN I SUE THEM?

You need to first discover and review the appeals policy for the college.
Ask the Dean of Students, or other official for guidance, if you are unable to uncover it.

This isn't a legal issue, it is a school administration issue. There are some courses which have very specific attendance requirements for good reason. If you can't solve it with the professor, talk to the department chair or dean.
