I was placed on salary with a promise of only 45 hours per week. As the workload increased "of course". I was not compensated for any of the time over 45 hours. I averaged 52 - 55 hours per week. I was not allowed to clock in or out. I did keep track of my time. This was called a management position by the company but I was not given any authority. Do I have any recourse or is going to end up being a just chalk it up to one of life's learning experiences?

Unless you had a bona fide contract that specifically stated that you could not be asked to work more than x number hours per week, you can be required to work whatever hours the employer finds it necessary for you to work. Regardless of your pay status.

The question is whether or not you qualify to be an exempt employee, and that's not something we can answer with the information we have available. If you do, then you are never, under any circumstances whatsoever, entitled to a penny more than your regular salary, regardless of how many or how few hours you work.

If you do not, then you must be paid overtime at the rate of 1.5 times your regular hourly rate for any hours over 40 in the week.
