Roommate Won't Pay Move-out Costs

I moved out of the apartment 6/30/2007 and paid my half of the rent for the next month as my 30-day notice to my boyfriend. Things had gotten pretty bad and I had to get out asap especially since I am pregnant. I discussed with him the terms of my moving - I had paid $240 for the electric deposit, which i agreed to allow him to keep, as well as the security deposits so he could have additional cushion to pay move out costs or for next month rent if he decided to get a roommate (it was a 2 bedroom 2 bath). Although I signed myself off the lease on the 30th, he did not sign my name off so I'm still liable for fees if he doesn't pay.

He later decided he would move out and verbally agreed to pay 100% of the move out costs. He will not talk to me and it will be soon turned over to a credit/collections agency if it's not paid. I will pay the costs to avoid having a dent in my credit, I just wanted to know if he could be held responsible for not paying what he agreed to pay.

I usually wouldn't be so petty about it but the total move out cost is approximately $900 and with a baby due any day and being a full-time student, well, I just don't have money laying around, especially since he hasn't paid a dime towards the child costs either, but that's another story. Thank you for your help and advice!
 
If your payments to him including the reasons for the payments, agreement between you guys are well documented, you would recover your money in small claims court. If you don't have eye witnesses or documentation to the agreement, that would be hard. It would be your word against his. Unfortunately from experience, the legal system in most cases make it looks like getting back at him after sour grapes……… The judge would need reasonable proof to award you the judgment. It would be good to mentain good credit as you suggested.....no matter what. Repairing a small dent in credit could take years......
 
He doesnt owe you anything for a baby that is not born yet and where paternity has not been established, FYI.

Were you on the lease? You did break it. Your boyfriend is required to mitigate his damages and look for another roommate but he might be able to get a few months of rent out of you.

If you are served with a small claims suit, you need to respond. All you can do is give your side and the judge will decide.
