Roommate Threats Roomate

    Hello,

    I have a situation in which I feel I may need some advice on.

    Our situation:

    My partner and I are currently leasing the basement apartment in a
    house. We've been paying rent here for the past 8 months. We recently learned
    that the Roommate agreement we signed might not be legal. The man we
    rent from has not given us the name or address of the landlord. The
    man we are renting from has asked us to leave 3 times in the past 8
    months for insufficient reasons. We were able to smooth each incident
    out by talking with him but each time he got increasingly more hostile.
    During the last incident he threatened to throw my partner down the
    stairs.

    We've begun to record all of our interactions with him. During our
    last interaction, he was attempting to have us move out again, but we
    insisted we have a lease. In which he replied that if we wanted to
    live in a hostile environment, "it's about to get a lot
    more hostile".
    Let me add, this person told us he spent time in jail/prison for assault.

    His behavior is erratic and bizarre, and he uses a good share of
    marijuana (at least). We knew he used marijuana and told us he grew in
    the back yard before we moved in, but never expected he did so on such a scale. He had about 18 plants growing in the backyard this summer and often has 4-5 people over to help him trim his marijuana. This happens in the
    living room. We need to cross that room in order to access our unit.

    The situation is affecting us in that we no longer feel safe here. It
    has begun to affect us physically. We also had to move our dog
    because we feared for her safety as well. We don't feel safe
    leaving our apartment unattended and have been forced to miss work so that we could keep an eye on our apartment (the basement we rent has no lock, and
    the washer and dryer is located downstairs in our unit.)

    We are no longer interested in staying because of the physical threats
    he is making but are also not in a position to move immediately. We are looking for a new place and hope to be out in the next week or
    two.

    Our questions:

    Are his physical threats legal? Could this be considered domestic
    violence in that we are just housemates? If so, what options are
    feasible for us until we are able to move out?

    If not, what can be done about it? We don't expect him to return our
    deposit and that isn't really the issue. Money is not our reason for
    staying, but it's unfortunate that his hostile threats and behavior is causing us to
    lose financially.

    Any advice would be appreciated.

    The agreement is likely illegal.

    How will that help either of you if he butchers you like chickens?

    Do yourselves a favor and leave.

    Save yourselves and the brute from tumbling into fates far worse than leaving.

    Why stay where you're unwanted?

    Be smart, live safe, remain free.

    Agreed. If this situation makes you feel unsafe, then it's time to move. His comments may not rise to the level of a crime in your unnamed state. In fact, they probably would NOT rise to the level of a crime unless they were coupled with actions or the present ability to carry them out. Not to mention the fact he will likely deny ever making any threat.

    As inferred by AJ, depending on the laws of your unnamed state and local ordinances, this rental agreement may well be unlawful. Subletting is not always permissible without the specific permission of the landlord, so you may well be in a place where you have no legal right to remain should push come to shove. It may well be time to find new digs.
