Removal of Vending Machine

I work in a small office in downtown Albany NY. We are limited in space and there fore do not have a cafeteria in house. Instead we utilized what space we do have for a vending machine that usually contains drinks and snacks. Our last owner of the vending machine was not a reliable vendor. His machine was broken more than it worked causing alot of staff to lose their money in his machine rather than be able to get a drink or snack. And alot of times when he finally would come to refill the machine, he would fill it with outdated items. Because of this situation we reached out to a different vendor and gave notice to the previous vending machine owner to remove his machine. We have no written contract with him. Since giving him notice to remove his machine we have not communicated with him except for one telephone message he left on our front phone line the day he was expected to pick up his machine. In the message he stated he could not come that day and to expect him the following day. This has been over a month ago. Since then we have called numerous times. Each time leaving a message asking for the removal of his vending machine and asking that he contact us. We have never heard anything from him. Do we have any rights? How long do we have to keep his machine in our limited space. Could we ask for storage fees or removal fees if we have to end up removing this machine? We are planning on sending a certified letter to him shortly and were hoping to find out more information if we could prior to sending the letter.

1) yes 2) After you have notified him that he has up to a certain date to remove it and he doesn't, you can get it out immediately. 3)Yes. 4) No additional information needed unless he doesn't show up and you need to sue him in small claims court for the removal and storage fees. Hope this helps!
