My jurisdiction is: Arkansas

I was wondering what I can do to gain custody of my 3 nieces (ages 10, 8, 5)and 1 nephew (age 3). Currently they are living in Texas with both their mother and grandmother. I was called yesterday by my sister (their mother) to come get them due to the fighting between her and our mother but upon doing so my mother said that she would call the cops and CPS first. The children have had to live with family violence their entire lives i.e. father beating mother almost daily, drug and alcohol abuse in home, parents fighting with other adults, mother and father in and out of jail, father is currently serving time for attempted murder, rape, 3rd degree battery, etc. in Arkansas which he inflicted upon my sister (the mother of these children). I am married and have 3 children of my own and I want nothing more than to have my sister children to be able to live with me. My husband is the only one working at this time and we can provide a loving home for these kids even if financially it gets a little tough. They have seen too much in their little lives and I fear that much more will result in fatal conseaquences for them. My 10 yr old neice found her 8 yr old sister trying to hang herself last week!!! That infuriates me to no end. Where are the adults when a baby is trying to commit suicide???????? There have been several other incidents like the one I've just mentioned but with out going into more details I am sure that you can see the importance of removing these children. Please help me I don't know what to do!!!!

all u really need to do is tell ur sister to move with u or give u temporary custody of her children in a letter that is notarized, unless the mother does not have legal custody of children/ the grandmother can threaten all she wants but if the mother is choosing to send the children with u for their own saftey child services wont do anything if you have a notarized letter of temporary custody from the mother

i did the same thing with my own children when i didnt have a place to live/ my mother has legal custody but is giving it back to me now that i got on my own feet

All a notarized letter does is confirm that she is who she says she is. Without going to court, a letter is worthless. See if sis will agree to guardianship or custody (the latter is harder to overturn) and take it to court. Dad will have to be served with any papers. Is he the legal dad, and are there any court orders for support/visitation for him?

Gma can call CPS but it won't guarantee the kids will get to live with her. She has no rights to them, neither do you. Get sis to make it legal for them to live with you before Gma can stir things up. It will have to be done in their state.

Since there are 2 states involved, you should consult a lawyer.
