I'm seeking a divorce from my husband of seven years and we have two children (2 & 4 yrs old). I haven't filled as of yet because I really don't know how to proceed. The grounds will be cruel treatment and we currently reside in New York State and still live together. I am a stay at home mom and desire to move back to my home town in Indiana for emotional and financial support, is that permissible? I do understand that he will want to see his children, however I pretty much raised them on my own and he just covered the financial part of it. Can you suggest a plan for visitation? I know he's going to fight me on this.
 
It is not likely a judge will permit such a move that keeps children from the other parent. Now if other parent agrees fine or if you leave and leave children with him.
 
You are going to have to ask for permission to move and prove that the move is in the kids best interest. Dad has also the right to seek custody since you plan to move. They are still his kids and he has supported you and them. Be prepared to provide some, if not all of the transportaion for visits should you be allowed to move. Start figuring out how you are going to support the kids too. Probably should get a job if you do not have one already.
