Regarding Negligent Hiring Lawsuits

I work for a employment service in upstate NY who does do some preliminary screening of people prior to helping them find employment. If for example I have someone with a criminal background with a sex offense and since my agency only does a county and city background check, this offense may not show up. If I were to help them gain a job say at wal-mart where they to, only do a drug test and this person relapses and assaults some one on the job.. I know that Walmart can be sued but can the employment agency as well?
