One year ago, myself and my son's father went to court to establish child support, visitation and so forth. On the first visit alone with my son, his father brought him home with 2 fractures in his elbow. He claimed it was an accident, which I completely understood, but he failed to render medical attention. My attorney and I immediately came forward to the judge and temporary supervised visitations were enforced until the emergency hearing occurred. My son's father failed to attend the emergency hearing, therefore the judge ordered the supervised visits until our final court date which was 2 months later. At the final hearing, my son's father again failed to appear. The judge ordered supervised visits, calculated all of the back-owed child support and the current child support. Since May 2008, my son's father has not attempted even one of the supervised visits, ignores him in public, is extremely behind on his child support, has failed to follow any of the rules on the signed orders and when I asked him why he hadn't attempted one visit, he said that things came up that couldn't be prevented, which he then explained it was because HE DID NOT WANT SUPERVISED VISITS. He called last night and informed me that he was going to take me back to court to lower his amount of child support, ( which I am currently receiving 50% of his paycheck), reverse the supervised visits with my son and that he was informed by his attorney that all of the back-owed support was going to be erased due to "problems with the system". My concern and question is that when we go back to court, will he possibly be able to reverse the supervised visits and wipe away all of the back-owed support?? Any help would be greatly appreciated.
