Proven falsified DCFS allegation

My fiance is in a custody battle with his ex-girlfriend for visitation rights to their now 5 year old daughter. She left to Alabama in December and has not been in contact since. In retaliation for being served with custody papers she called DCFS stating that she was in our home 2 weeks ago and that she witnessed him abusing me and my daughter, that I help abuse my daughter, that we starve my daughter, that we live in squalor, and that he is highly intoxicated on a regular basis and that he cares for my daughter in that state.

Note: I use the words my daughter because in our hearts he is her father but legally he will not be until the adoption is finalized after we marry, sometime in late May. Also, since he is not legally her father the DCFS investigation was technically only brought against me and put in my name.

The dcfs investigator came to our home and not only saw that the accusations were untrue but falsified. Not only did this woman state she was in our home two weeks prior (around the same time she was being served with papers in Alabama, you can't be in AL and IL at the same time) but she not only gave out dated information in regards to where we lived and with whom but also where my fiance works, information that dates back to Dec.

The investigator closed the case and was able to file it as harassment since she did not make the report anonymously but I'm not exactly sure what that means.

I would like to know what civil and criminal action can be taken against this woman. I know that since 2012 in the state of IL it is now a Class 4 felony to knowingly make a false accusation to DCFS. How would I go about making sure criminal charges are brought against her. Also can I sue for slander and defamation of character, as this will go into my daughters medical file for life and also will stay in DCFS records for the next 36 months?

I am sorry if I am in the wrong thread or if this should be posted in more that one thread. Please advise if this is the case and thank you in advance for all of your help
 
I suggest you do nothing.
You were exonerated.
You plan to attempt to adopt the child.
If you want that to go easy, don't rile the mother.
Even if you decide not to adopt the child, or don't succeed, dad has to co-parent the child with the mother.
Plus, the fireworks will certainly disturb the child.
Beyond all of the above,you're not even married.
Who knows, you might not get married.
Truthfully,you're a legal stranger in the eyes of the law no far as the child is concerned, no matter what you and dad eventually become.

My last bit of advice is meant to to disparage you, but to protect her.
Stop referring to the child as your daughter.
Continuing to do so will only cause the mother to make more trouble for you.

This woman tried to have my daughter taken from me as retaliation for my fiance trying to get full custody of their daughter that they share. I was just wanting to know my rights in this situation

Wrestling in the feces and urine filled mud with a dirty, smelly, filthy pig is only going to get you soaked and caked in the pig's feces and urine, all the while the pig is having the greatest time ever in her filthy pig pen watching you getting dirtied with her swine excretions.

The smartest thing anyone can ever do is improve your life, enjoy your life, and never seek revenge.
 
I completely understand what you mean. I would, though, like to know all of my options should this woman continue playing these ridiculous games.

I may not seek any type of civil or criminal action as of now but if she continues to call DCFS and disrupt my life I want to be ready with at least knowing my options.

You're free to sue anyone you want to sue.
You're also free to speak with your county attorney or district attorney to request criminal charges be lodged if the swine lied about you to DCFS violating your state's criminal laws.

Any civil case against the swine is on your dime.
You appear to understand things, so now you simply need to make the proper choices that comport with your wishes.

I prefer to spend my money to support my lifestyle, assist my grandchildren with college tuition, take a few trips throughout the year, fund my many hobbies, save some money for rainy days, and help my family at times of their need.
