Do I have a case where a burglar used a listing agents key to gain access to my house to commit a crime? He has been plead guilty to a class C Agg. Burg. charge, admits where he got the key, which is same location the Realtor admits where he negligently left the key. The key was placed in this location more than a week after closing, and no one was ever notified of this key being placed there. "Damages" from this would be loss of work for a week, numerous costs from the event itself, my families mental anguish from the intruder, counseling costs not covered by insurance.
 
You are always free to pursue a lawsuit against anyone you feel has transgressed against you.

Only the judge that hears the matter can decide.
 
Talk to a lawyer & get his/her opinion as to whether you have a case.
 
How did this key come to be randomly placed? Where was it? Why was a key box not used? How did the burglar know where to find it?
