probate of will

My mother died in feb 04. My brother is executor of the estate. He never
filed her will with probate court, he says his attorney advised him not to.
His attorney also advised him NOT to close out my moms bank accounts and her shares of stock., I do not know why, he has given us no explanation on that. The bank has been collecting fees for the last 5 years, the stock is now worthless. The bank accounts were in my mothers name only.
My sister, who had power of attorney, is still listed as a contact on my mothers accounts and just received a letter from the bank stating that the money in her accounts will be turned over to the state of Ohio as unclaimed funds. My brother has done nothing for the last 5 years and is doing nothing now.
Is there anything my sister and I can do to get these accounts closed? Any information you can give would be extremely helpful. Thanks!
 
Get a lawyer and bring an application to compel the executor to perform his duties or be removed. And possibly, seek an accounting of the estate and sue for improper performance in allowing it to waste.
