Private road liability

I live on private road with 11 other houses. We paved it last year and pay taxes on it together. If one house does not contribute and there kid gets hurt on it because they are riding a quad around on it whos liable?
 
Have the owners of the house never contributed or they just stopped contributing?
 
They have never contributed. Its a single mom(husband died 2 yrs. ago) with two boys, ones a teenager and the other maybe 10. She really didn't have the money to contribute to the road. She doesn't contribute money to the plowing or taxes either, that bothers me more. The problem is her teenager has been taking his 4 wheeler on the road. If he hits a tree and gets hurt, who's liable?
 
Everyone that lives in the private road is liable. Be proactive, check your city or town's ordinance regarding private roads and ask all the homeowners that live in that private road to get together and reinforce the idea that safety is strongly encouraged when it comes to any type of activities on the road.
