An employee of mine has had a long-term child support battle in Family Court. All she is asking for from father of her child, is for him to carry health insurance on him. He and his current wife have countered with an attempt to be repaid support he'd paid for child care ($25 per week), for a period of time when she didn't need child care.
Today, they were scheduled to appear before the Family Court Judge, however, my employee was very distraught and didn't want to appear, fearing that she would say or do something that she'd regret. She called the court and told them that she was on her way back from vacation. The court officer told took her cell phone number and told her to pull off the road at a certain time to take a call from the judge. However, she was not actually on the road at the time. When the judge called, the wife of her son's father yelled out that she had seen her 2 days before at a local supermarket. The judge asked her if that was possible, and my employee said no...she panicked and just blurted out that response. She was not under oath during this phone call, but she is worried that her son's father's wife will somehow get ahold of a security video from that store...to prove that my employee is lying. It wasn't her intention to lie about anything, but she didn't think things through, and now she is worried. She knows that her son's father's wife will do anything to hurt her; that she won't let this "lie" die. What should my employee do? Could she be charged with perjury for this? It's effecting her work, as she is afraid that she could face jail time. Any suggestions please?
