Question? I bought my house prior to marriage. The house is in my name only.
We both are on the deed but my husband does not have a job and has not paid the mortgage in over 2 years. He recently locked me out of our home and has changed the locks. We did go before a judge to get temporary child custody and the judge orded us both 50/50 custody. My question is, I am going to court this week to hopefully return back to my house. My husband is not paying the bills and mortgage so do you think that the judge will order the house back into my possession?

Right now I am paying rent and I will have to pay back mortgage to keep myself out of foreclosure. We do own rental propoerties and one is comining available at the end of April so I am hoping that mu husband can go live there. He lived there last year when we seperated for a short time.

I just cannot believe that he locked me out of my house and am wondering what you experts think may happen.

Thanks!

He has no right to lock you out of the house. I would find a way to get back in, call the police if necessary to see if they can help you. Just because he locked you out doesn't mean he has the right too. Do you have an attorney? Seems like if you have a hearing coming up, you probably will be able to get back into the house. I wouldn't wait for the hearing. Call the ppolice to see if they can help you get back in the house.

I do have an attorney and she said that since the children would be put in the middle (if we were to go back & forth) the judge might get mad so she said to wait for the judges order. We go on Friday but my husbands attorney has already postponed it once and I am tired of waiting... I need my house back...

I just want to make sure that you think that I would get the house back. I put down 100K prior to marriage and my husband did not include any money to the house. He may have paid 6 months of mortgage when we were first married but the last 3 years, he has paid nothing.

Thanks!
