"Rita" has chosen to use her body to support herself. She chooses to find potential investor/actor/model seeking to participate in her business venture. "Rita" is not a prostitute, but rather an aspiring adult performer. All other actors participate in a "buy in" for profit sharing when and if the business takes off. She stars in all her films with the potential investor/actor/model she finds on the street. One day Rita was picked up by a potential investor/actor/model (or so she thought) and is being accused of solicitation. Does the state have a case against her for prostitution? Why or Why not?

I myself prefer to go the Common Law route where they must produce an injured party or there is no crime.
