pls advice

I have a 3 yr old daughter. I have never been married and do not have her fathers name on the birth certificate. Paternity has never been established. The father has been absent from day one. I moved to NY a year ago. I got served from a court for child visitation/custody from the state where the father resides (not NY). Is this possible since I do not reside in that state? What do I do next?

How long have you been absent from the State the Father resides in? If you have been where you are for 6 months or more it is likely that you can have venue transfered to your State. I'm glad the Father is finally taking an interest in the child. A child needs both parents to be involved. He will likely have to pay for transportation because he was not involved when you moved.

The first step will be a determination of paternity (at his expense), then they will set up child support, and then they will set up visitation. It's a good thing, don't worry.

I have been out of state for almost a year. I hired an attorney in my home state who called up the court in the fathers home state and faxed over some papers to them. I was told by this attorney, I do not have to show up in the fathers home state court and that they will dismiss this case.
