My fiance's sister was evicted from her house today and is now in a homeless shelter with her two infant daughters under the impression that if she stays there long enough the state will provide her with free housing. We do not want to see our nieces in this kind of enviroment. Will the state of Maryland actually let them stay with the mother in a homeless shelter or will they put them in foster care? Is there a way that we can obtain gaurdianship of the children to prevent this from happening?

Probably not. Are the children in any real danger? If not, then it's unlikely that you can obtain guardianship. Plus, the state of Maryland has services that your fiancee's sister can access to help her in this situation.

Why don't you allow her to move in with you temporarily? You can certainly ask sister to give you guardianship over the babies until she gets on her feet but she doesnt have too. Where is the babies father? She should be pursuing CS from him. She should be contacting the state to get on a waiting list for Section 8 and for food stamps.
