We are trying to decide whether we should pursue a claim against the City for coverage of medical bills which ensued from an injury on a child's playground. Here's the situation:
At a local playground my son (age 4) jumped up in attempt to climb a chain link fence which surrounds the play area. We were unaware that the top of the fence was either unfinished or installed improperly, and my son's hand was badly cut. The cut required 10 stitches.
We have no insurance, and we know the bills from the emergency room and subsequent doctor's visits will be expensive.
Our question is this: is the City liable in this situation? My feeling is that a fence around a playground, within reach of small children, should be free of sharp metal pieces. Any advice would be greatly appreciated. Thanks!
