If two people live within a 15 min drive of eachother and have already established a precedent for having a child live within both households, can the courts grant phiysical custody to one parent because they are married now and have that spouse to help care for the child more? My ex is trying to take physical custody of our 8yr old girl and considers his new wife to be able to meet the needs of our growing daughter. He wants me to only have visiting rights where in the past 4yrs we've managed to share our daughter.He claims that my job interfers with his schedule and that if I have to work he must make accomodations. He wants our daughter to live with him and have me pay child support? Would his claim sound reasonable to the courts. I have obtained a lawyer and he says not to worry... :(
