What is better, to have an individual own the trademark or to have a corporation own a trademark? Currently I have a subchapter S owning the mark but I want to close that business and have another buisness use the mark--a new sole proprietorship business. I was thinking of just assinging the mark to me personally. Is this a bad move? Does it expose me personally to more risk? I have a granted mark, but have seen two businesses recently encroach on my mark and I plan to contact them to cease and desist. I want to make sure I am protected well when I contact these businesses. Thanks for your help and advice

Sell the trademark your new corporation for a $1.00.

Your question is a good one because improper ownership can put your registration at risk. That is, the registration should be issued (or assigned or liscensed) to the entity or person that is offering the goods/services thereunder, or otherwise stated to the entity that controls the use of the mark.
