Hello,

I'm an employee who has assisted on several projects to help assist other business partners within the company. For 5 months I performed two full time positions successfully and when told that I was not going to get the pay increase I was then removed from assisting these other departments.

The problem, I wrote several process documents for the business and for Sox purposes and I never received a discretionary award or a pay increase. I helped save the company an additional salary payout because I performed the job of two individuals. Can I sue this company to obtain payout for the services I provided outside my current job function because I was never paid overtime, all work was performed because I cared and understood the business need?

You do the duties that are assigned to you.

If you are nonexempt, you must be paid for all hours worked and overtime pay if you work over 40 hours in a workweek.

If you are exempt, you are NEVER legally entitled to anything more than your regular salary, no matter what "extra" work you are doing and how many "extra" hours you spend doing it.
